Waste Collection Belsize Park Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste collection services in and around Belsize Park to domestic and commercial customers. By making a booking, confirming a quote, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation who requests and pays for the waste collection service.

We, us, our means the waste collection service provider trading under the name Waste Collection Belsize Park.

Services means the collection, removal, loading, transportation, and lawful disposal or transfer of waste as agreed with the Customer.

Waste means any items, materials, rubbish, junk, refuse or other discards that the Customer requests us to remove, excluding hazardous or prohibited items unless expressly agreed in writing.

Booking means a confirmed request for Services made via telephone, email, online form, or in person and accepted by us.

2. Scope of Services

We provide scheduled and one off waste collection services, including general household waste, garden waste, bulky items, and light commercial waste, within our operational area that includes Belsize Park and surrounding districts. The precise scope of each job, including the volume and type of waste to be removed, collection address, access conditions, and timing, will be agreed with you at the time of booking or as updated in a confirmed quote.

We reserve the right to refuse any item or load that we reasonably consider unsafe to handle, unlawful to transport, or not in line with our environmental obligations or licensing conditions.

3. Booking Process

3.1 You may request a quote or make a booking via our customer service channels. To process a booking, you must provide accurate information, including your name or company name, contact details, collection address, waste type and approximate volume, and any access restrictions.

3.2 Any quote we provide is based on the information you supply. Quotes are given as estimates and may be adjusted if, on arrival, the actual volume, weight, or nature of the waste differs substantially from what was described. We will inform you of any change in price before commencing work and obtain your approval.

3.3 A booking is only confirmed when we accept it and provide you with a collection date or time window. We may decline a booking at our discretion, for example if we do not operate in your area, do not have a suitable vehicle, or if the waste is not acceptable under our policies or legal requirements.

3.4 We aim to arrive within the agreed time window but do not guarantee specific arrival times. Time windows are indicative and subject to road conditions, earlier jobs, and operational factors. We will use reasonable efforts to notify you if we are significantly delayed.

4. Customer Responsibilities

4.1 You are responsible for ensuring that we have safe and reasonable access to the waste and the collection area. This includes providing accurate directions, arranging parking or permits where required, and informing us of any access codes, restricted zones, or obstacles.

4.2 You must ensure that the waste intended for collection is clearly separated from items you wish to keep. Our operatives will not be liable for removing items that a reasonable person would assume were intended for disposal.

4.3 You confirm that you either own the waste or have obtained full permission from the owner to dispose of it. You agree to indemnify us against any claim from a third party alleging that the removal was not authorised.

4.4 You must not present for collection any hazardous waste unless we have expressly agreed to accept it in writing and you have complied with all pre conditions we may specify, such as packaging or labelling requirements.

5. Pricing and Payment

5.1 Our charges are based on factors including the estimated or actual volume of waste, its type, ease of access, labour time, and any special handling or disposal fees required by law or our disposal partners.

5.2 Unless otherwise agreed in writing, prices are quoted inclusive of standard disposal charges but exclusive of any congestion, parking, toll, or permit costs that may be incurred as a result of local conditions. Any such additional costs will be added to your final invoice where applicable.

5.3 Payment is due on completion of the collection, unless we have agreed to invoice you on account terms. We accept common payment methods including cash, card, and electronic transfer, subject to availability at the time of service.

5.4 For account customers, payment terms will be specified on the invoice. If no specific terms are stated, invoices are due within 14 days of the invoice date. We reserve the right to charge interest on overdue sums at the statutory rate permitted under UK law and to recover reasonable costs incurred in pursuing late payment.

5.5 We may require a deposit or full prepayment for certain bookings, such as large clearances, commercial work, or out of hours appointments. Any such requirement will be notified at the time of booking.

6. Cancellations and Changes

6.1 You may cancel or reschedule your booking by contacting us directly. To avoid cancellation charges, you must provide at least 24 hours notice before the agreed collection window.

6.2 If you cancel with less than 24 hours notice, we reserve the right to charge a cancellation fee to cover our costs, including staff time, administration, and any lost opportunities to undertake alternative work.

6.3 If our operatives attend your property and are unable to carry out the collection for reasons within your control, such as no access, incorrect address, insufficient parking permissions, or the waste not being ready, we may charge an attendance fee or the full quoted amount at our discretion.

6.4 We may cancel or postpone your booking in circumstances beyond our reasonable control, including but not limited to vehicle breakdown, extreme weather, accidents, industrial action, or changes in legal or regulatory requirements. In such cases, we will attempt to offer an alternative time, but we will not be liable for any indirect losses arising from the rescheduling.

7. Waste Types and Regulations

7.1 Our services are provided in accordance with applicable UK waste management legislation and guidance. We hold or arrange for all necessary licences and registrations required to collect, transport, and transfer controlled waste.

7.2 We do not routinely collect hazardous waste, including but not limited to asbestos, certain chemicals, solvents, medical waste, gas bottles, explosives, or radioactive materials. If you are unsure whether your items are classified as hazardous, you must inform us in advance and follow our instructions.

7.3 If you present hazardous or prohibited items without prior agreement and our operatives only become aware upon arrival, we may refuse to remove those items and may still charge a call out fee to cover our costs. If the presence of such items renders the entire job unsafe, we may decline the whole collection.

7.4 We will dispose of or transfer waste only at authorised facilities, in compliance with duty of care requirements. Where required, we will complete waste transfer documentation accurate to the best of our knowledge based on the information provided by you.

7.5 You must not ask our operatives to dispose of waste in any way that would breach environmental regulations, cause pollution, or result in unlawful dumping. We reserve the right to refuse any request that, in our judgment, could lead to non compliance.

8. Liability and Insurance

8.1 We will exercise reasonable care and skill in providing our services. Our operatives will take sensible precautions when moving items through your property and loading waste onto our vehicles.

8.2 We hold appropriate public liability insurance to cover accidental damage or injury directly caused by our negligence while carrying out the services. Details of our cover are available on request.

8.3 We will not be liable for:

a. Any damage caused as a result of pre existing defects, poor structural condition, or fragile surfaces at your property, including but not limited to cracked paving, loose tiles, weak walls, or unsecure fittings.

b. Damage or loss arising from your failure to remove or adequately protect non waste items in close proximity to the collection area.

c. Consequential, indirect, or economic losses, including loss of profit, loss of business, or loss of opportunity, even if such loss was foreseeable.

8.4 Our total liability to you for any claim arising out of or in connection with the services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable for the specific job giving rise to the claim, except where such limitation is not permitted by law.

8.5 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded under UK law.

9. Damage and Complaints

9.1 If you believe that our services have caused damage to your property, you must notify us as soon as reasonably practicable and in any event within 48 hours of the incident or discovery. You should provide photographs and a clear description of the issue to enable us to investigate.

9.2 We will consider all reasonable complaints and, where appropriate, may inspect the property or request further evidence. If we accept responsibility, we may arrange repair, replacement, or a fair financial settlement, taking into account the age and condition of the property affected.

9.3 If you are dissatisfied with our response, you may pursue your rights through the courts or an alternative dispute resolution method where available. These Terms and Conditions do not affect your statutory rights.

10. Access, Parking, and Permits

10.1 You are responsible for arranging any parking or access permissions required for our vehicles to attend your property. If special permits or visitor passes are needed, you must have these ready and communicate any relevant restrictions in advance.

10.2 If parking restrictions result in fines or penalties directly attributable to your failure to provide correct information or permits, you will be responsible for reimbursing these costs in full.

11. Health and Safety

11.1 We operate in accordance with relevant health and safety obligations. Our operatives may refuse to proceed with work if they believe it would pose an unacceptable risk to themselves, you, or others.

11.2 You agree not to instruct our operatives to undertake any task that is unsafe or outside the normal scope of waste collection, such as structural demolition, working at unprotected heights, or entering confined spaces without proper equipment and training.

12. Data Protection and Privacy

12.1 We collect and process personal information such as your name, contact details, and job history for the purposes of administering bookings, providing services, handling payments, and managing customer relationships.

12.2 We will keep your personal information secure and will not sell or share it with unrelated third parties except where necessary to deliver the services, comply with legal obligations, or enforce these Terms and Conditions.

13. Termination

13.1 We may terminate or suspend the provision of services to you immediately if you breach these Terms and Conditions, fail to pay amounts due, act abusively toward our staff, or engage in unlawful behaviour in connection with the services.

13.2 Termination does not affect any rights or obligations that have already accrued up to the date of termination, including our right to recover outstanding payments.

14. Variations to Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, industry practice, or our business operations.

14.2 The version in force at the time you make your booking will apply to that specific job, unless we have agreed in writing to adopt a different version.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of waste collection services, subject to any mandatory rights you may have as a consumer to bring proceedings in your local court.
